Expungements
Expunging your criminal convictions is a great way to clean up your record. Once expunged, a case cannot come back to haunt you on job or school applications that ask if you were ever convicted of a crime. However, an expunged conviction must still be reported if you are applying for a license from the state, or a permit to carry a weapon.
You a legally entitled to have your case expunged on any case where you were placed on probation, probation has already expired or been terminated, and you completed all of the terms and conditions of probation successfully without ever violating probation.
You are legally entitled to only make application for expungement on any case where you were placed on probation, probation has already expired or been terminated, but you violated probation during the probationary period. In this situation, expungement is up to the discretion of the Judge and may be objected to by the prosecutor.
Many people do not realize that they have, in fact, violated probation simply by asking the Court for a re-referral to comply with their probation conditions such as an alcohol, drug or anger management class, or their community or public work service. In this situation, the right to an expungement is lost, but it is still within the discretion of the court to grant it.
